Income Tax Liability
Under the terms of the Taxation of Income from Landlords (Non-Resident) Regulations 1995 (Finance Act 1995), while a Landlord may be considered non-resident for tax purposes they still have to pay United Kingdom income tax on rents arising in this country. An exemption certificate can be obtained from the Inland Revenue if your tax affairs are up to date.

Your Mortgage
If your property is under mortgage you are normally required to inform the lender of your intention to let out the premises. There will usually be no objection, provided there are no arrears, but there may be an administration charge payable, which will vary from lender to lender.

Insurance
Whether your property is to be let furnished or unfurnished, you will need to arrange Buildings and contents cover. The Building insurance may be included in your mortgage repayments but you will need to inform your existing contents insurers that you are renting out your home.

Furniture and Furnishings
The purpose of The Fire (Safety) Amendment Regulations 1993 is to improve safety by requiring all furniture and furnishings in rented properties to meet the "cigarette test".
Most new furniture is marked with a label to show it passes the test (a triangle with a smoking cigarette), or in the case of beds and mattresses a label marked BS 7177. The regulations apply to all upholstery and upholstered furniture and loose fittings, permanent or loose covers including: beds, mattresses, pillows, armchairs and scatter cushions.

The Gas (Safety) Regulations 1994
On the 31st October 1994 the gas safety regulations came into effect. Under the regulations, it is the responsibility of anyone letting their property to ensure any gas appliance or pipe work installed in the premises are maintained in a safe condition.

The Landlord must make sure all gas appliances, pipe works and flues are checked for safety at least once a year by a qualified gas engineer (CORGI registered) or by British Gas. A record of each inspection must be kept and a certificate must be available for the Tenant or Local Authority to inspect.

Electrical Equipment (Safety) Regulations 1994
From the 9th January 1995 it became a criminal offence to supply electrical equipment which is unsafe. Equipment is unsafe if, as a result of any defect, it jeopardises the safety of people, domestic animals or property. Whilst the act does not impose any duty on the supplier to carry out safety checks we would recommend inspections are carried out at least once a year.
